What is mediation and do I qualify for mandatory mediation sessions?

Mediation provides an opportunity for you and your landlord to reach an agreement without legal action in court.

You may qualify for mandatory pre-eviction mediation if you receive the following public benefits:

  •  Supplemental security income (SSI)
  • Federal social security disability insurance (SSDI)
  • Cash assistance through the Colorado Works program (TANF)

Under Colorado law (HB-23-1120), your landlord must offer to participate in a mediation session with you before filing an eviction in court if you inform them in writing that you receive these benefits. This mediation session will be free to you and will be facilitated by neutral trained mediators. You are allowed to have a lawyer or other legal representative with you at the mediation session.

If you do not notify your landlord in writing, you will waive the right to a mandatory mediation session. For more details, please visit the State website.
